When is a property considered to be an ETV and will the Balearic Tourism Law apply?
It’s a valid ETV license in the Balearic Islands whenever:
- rent the whole of your home, and
- for periods of short duration, for days or weeks (maximum one month).
When you rent a property for periods of one month or less you are holiday renting. As a result, the laws relating to ETV holiday rental licenses must be applied.
For instance, to rent out a residential property without meeting the regulatory requirements will be considered a serious infraction of the laws.
Differences between the modalities of ETV
- ETV365-Un: Tourist stays in single-family homes.
The ETV365 is the license specifically for single-family homes and its use and restrictions are:
- Tourist stays in single-family homes (villas)
- The registration for a license does not expire
- For rentse all year round.
There are several types of single-family homes:
- A single-family home is one that has no other adjoining housing or it is the only property on the plot where it is located.
Independent spaces that are located in multi-family buildings (apartment blocks and flats) subject to the horizontal property regime are not considered single-family homes.
- The single-family homes that share a common side wall with other properties, for example, linked villas or semidetached properties. However, the property must have its own plot (parcela).
- The semidetached properties that share the same plot with the other properties, for example, a community of properties or townhouses.
- ETV365-Pluri: Tourist stays in multi-family dwellings.
The license for ETV365 properties expires in 5 years and is renewable.
You can rent ETV365 properties throughout the entire year.
- ETV60: Tourist stays in main residence properties
If you list yourself in the empadronamiento list as living in the property you can rent your property for a maximum period of 60 days per year. The license expires in 5 years and is renewable.
